Terms of Service for PicLab
1. Acceptance of Terms
By accessing and using PicLab, you agree to comply with and be bound by the following terms and conditions. These terms apply to all visitors, users, and others who access or use the service. If you do not agree with any part of these terms, you are prohibited from using PicLab's services. Your continued use of the service constitutes acceptance of these terms. PicLab reserves the right to modify these terms at any time, and such modifications will be effective immediately upon posting the updated terms on our website. It is your responsibility to review these terms periodically for any changes.
2. Services Provided
PicLab offers an AI-powered platform designed to generate unique and high-quality images based on user input. The services are divided into free and premium plans:
- Free Plan: Includes basic features and allows a limited number of image generations per month.
- Premium Plans: Offer enhanced functionalities, higher resolution images, and increased generation limits. Additional features may include priority support, advanced customization options, and access to exclusive content. PicLab reserves the right to modify, suspend, or discontinue any part of the service at any time, including the availability of any feature, database, or content, without prior notice or liability. Users will be notified of significant changes via email or through the service.
3. User Conduct
Users agree to use PicLab in a manner consistent with all applicable laws and regulations. This includes, but is not limited to, the following:
- Prohibited Content: You must not use the service to create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. This includes content that infringes on intellectual property rights, privacy rights, or is discriminatory in nature.
- Interference: You must not attempt to interfere with or disrupt the operation of PicLab, its servers, or networks connected to PicLab. This includes spreading malware, hacking, or using automated systems to access the service.

4. Intellectual Property
All content generated by PicLab, including but not limited to images, text, and software, is the property of PicLab or its licensors. Users are granted a limited, non-exclusive, non-transferable license to use the generated content for personal or commercial purposes, subject to the terms of this agreement. This license grants you the right to:
- Commercial Exploitation: Sell, resell, or sublicense the generated content without the need for explicit permission from PicLab.
- Modification: Modify, alter, or create derivative works from the generated content.
- Infringement: Use the generated content in any way that does not infringe upon the intellectual property rights of PicLab or any third party.
5. Payment and Refunds
Access to certain features of PicLab requires payment of subscription fees. These fees are detailed on our pricing page and may vary based on the selected plan. Payments are processed securely through our third-party payment providers. All payments are non-refundable except as required by law. PicLab reserves the right to change its fees at any time. In the event of a fee change, users will be notified in advance, and the change will apply from the next billing cycle. Users are responsible for providing accurate billing information and ensuring their payment method remains valid. If a user terminates their subscription, no refunds will be provided for the remaining period.
6. Privacy Policy
PicLab is committed to protecting your privacy. Our privacy policy outlines how we collect, use, and safeguard your personal information. By using our services, you consent to the collection and use of your information as described in the privacy policy. 7. Disclaimer of Warranties
PicLab is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, secure, or error-free. We do not warrant that the results obtained from using the service will be accurate or reliable. PicLab disclaims all warranties, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You understand and agree that any material or data downloaded or otherwise obtained through the use of PicLab is done at your own discretion and risk. PicLab is not responsible for any damage to your computer system or loss of data that results from the download or use of the service.
8. Limitation of Liability
In no event shall PicLab, its affiliates, officers, directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the service, even if PicLab has been advised of the possibility of such damages. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses. Our total liability to you for any damages, losses, or causes of action shall not exceed the amount you have paid PicLab in the last twelve (12) months, or, if greater, one hundred dollars ($100). Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
9. Termination
PicLab reserves the right to terminate or suspend your access to the services, with or without notice, for any conduct that we believe violates these terms or is harmful to other users, PicLab, or third parties. Upon termination, your right to use the services will immediately cease, and any content or information you have generated or stored on PicLab may be deleted. You agree that PicLab shall not be liable to you or any third party for any termination of your access to the services. Users may also terminate their account at any time by following the instructions on the PicLab website. Upon termination, you must cease all use of the services and destroy any copies of content obtained through the service.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PicLab operates, without regard to its conflict of law principles. Any legal actions or proceedings arising out of or related to these terms shall be brought exclusively in the courts of that jurisdiction. You agree to submit to the personal jurisdiction of the courts located within the jurisdiction and waive any objections to the exercise of jurisdiction over you by such courts. You further agree that any disputes, claims, or causes of action arising out of or connected with these terms shall be resolved individually, without resort to any form of class action.
11. Changes to Terms
PicLab may revise these terms of service at any time. Any changes will be posted on this page and will take effect immediately upon posting. We will notify you of significant changes through the service or via email. Your continued use of the services after such modifications will constitute your acknowledgment of the modified terms and your agreement to abide by and be bound by the modified terms. If you do not agree to the new terms, you must stop using the services and, if applicable, cancel your subscription.
